fa مرز میان بخش عمومی و بخش خصوصی در حقوق ایران با تأکید بر برنامه خصوصی‌سازی و برون‌سپاری پژوهشي Research <p style="text-align: justify;">تعیین مرز میان بخش خصوصی و عمومی و سازمان‌های عمومی و خصوصی بسیار مهم و اساسی است. تقسیم کار ملی و تعیین قلمرو فعالیت بخش خصوصی و قلمرو حکومت منطق بازار، به تمایز صحیح میان بخش خصوصی و عمومی بستگی دارد. همچنین، این تقسیم بر نگهداری حساب‌های ملی و تعیین استانداردهای حسابرسی بخش عمومی تأثیر اساسی می‌گذارد. علاوه بر این، تفکیک فوق در تعیین مقررات حاکم بر فعالیت‌های اقتصادی اشخاص عمومی، نقش تعیین‌کننده دارد. اجرای صحیح برنامه خصوصی‌سازی نیز نیازمند تعریفی دقیق از بخش خصوصی است. در این مقاله، تعاریف قانونی بخش خصوصی و عمومی و سازمان‌های این دو بخش مورد بررسی و نقادی قرار گرفته و نشان داده شده است که تسری تعاریف خاص ناظر به امور مالی و محاسباتی، به قانون اجرای اصل چهل و چهارم قانون اساسی و اتفاق مشابهی که در قانون مدیریت خدمات کشوری افتاده است، موجب پیچیدگی‌های حقوقی غیرضروری و در بعضی موارد انحراف در برنامه‌های خصوصی‌سازی و برون‌سپاری شده است. مسأله تقسیم کار ملی و این که چه اموری شایسته آن است که توسط بخش عمومی انجام شود و در چه مواردی دولت و بخش عمومی نباید فعالیت یا مداخله نمایند، موضوع این مقاله نیست</p> <p>From legal perspective, the boundary between public and private sectors and organizations is of great importance. The distinction between private and public sectors affects prominent issues like balancing the territories of market and government, determining the scopes of private and public sector functions, implementation of national accounts and Public Sector Accounting Standards, specifying laws governing the economic activities of public sector organizations and programming the privatization.<br> In this article legal definitions of public and private sectors and their organizations are criticized, and it is demonstrated that generalization of public accounting act&rsquo;s definitions to other laws - like enforcement of general policies pertaining to principle 44 of the constitution of the Islamic Republic of Iran act (a law on privatization) - has resulted in legal complications, misunderstandings and some deviation in privatization and outsourcing processes.
